In almost any area you can imagine, new construction is steadily popping up in the form of townhouses, condominiums, single
homes and recently there has been an increase in the “over-55 communities.”
Many of the properties are absolutely beautiful with open kitchen area, over-sized family rooms, and upgrades that you have
not yet imagined, there are still many pitfall that you might get into in regard to new construction. Not to mention all of
the delays, building defects and cost over runs.
Because of the many pitfalls, it is imperative that buyers become completely familiar with their legal rights. The time to
learn about your rights, is before they are violated. If construction defects and delays impede your move in date, do not
hesitate to bring legal action, as that is the only language some builders understand.
The “implied warranty of reasonable construction” and “implied warranty of habitability” exist between a builder-vendor of
new construction and a buyer regardless of whether any mention of such warranties is actually written into the contract of
sale.
Your warranty should include that habitability of the property and should be very detailed in the quality of construction
that you can expect and demand.
What this means, is the when you purchase your new and beautiful townhouse on a golf cours, you should be able to expect that
if the builder has done shoddy construction, you will have recourse to have the repairs done in a timely manner.
After you move in, and notic severe water leakage which may lead to mold growth, defective plumbing, unpure water supply and
even a shaky foundation can result in severe punishment to the builder.

1. The builder has an obligation to make sure the home is built with reasonable workmanlike manner, and is totally fit for
habitability.
2. You have a right to clear unambiguous warranty that is not confusing.
3. Be sure you read the contract from stem to stern and ask questions about anything that is not crystal clear.
